On May 03, 2022, an employee of the Red Apple reported two high school aged males were responsible for spray painting graffiti on the roof’s building. Independent witnesses came forward who had seen the youths and instructed them to get off the roof. A video recording of this violation of the law was secured along with the identification of the two youths.

Elk Valley RMCPolice responded to the scene and after a very thorough investigation, the two youths and their parents were spoken to regarding this mischief behavior. Both youths were quite apologetic and wished to make their wrong actions right by being accountable and responsible for the harm they caused. Instead of proceeding through the criminal just system, an alternative was introduced to the victims, youths and their parents.

It is a means of crime reduction in the community.
Restorative Justice is part of the Ministry of Public Safety and Solicitor General’s Crime Prevention Information Series. It is a process which addresses the needs of victims and the community and holds offenders accountable for the harm they caused. The program ensures that those who participate keep their commitments, which may include making restitution or completing community services.

Elk Valley RCMPolice actively continues with their investigation with the aim of a positive resolution to those who are involved.

Bullet hole to BC Hydro Transformer, Sparwood, B.C.

On May 04, 2022, BC Hydro reported one of the irrigation transformers located south from Hwy 3 and 93 intersection near Elko, B.C. was shot at. The costs to repair the damaged transformer and the ground clean-up is estimated to be close to $10,000.00.

The person(s) responsible for committing this type of criminal mischief can be charged under Section 430 of the Criminal Code of Canada (C.C.C.). Mischief comes in various forms and is defined by the C.C.C. reads as follows:

Section 430.(1) Every one commits mischief who willfully
a) Destroys or damages property;
b) Renders property dangerous, useless, inoperative or ineffective;
c) Obstructs, interrupts or interferes with the lawful use, enjoyment or operation of property; or
d) Obstructs, interrupts or interferes with any person in the lawful use, enjoyment or operation of property.

The penalty depends on the circumstance(s) of the case.

A similar incident happened in June of last year.
